Overview

The man killed by police in Atascadero early Tuesday morning has been identified as 34-year-old Josue Gallardo, a transient from Paso Robles.

The San Luis Obispo County Sheriff's Office released new information into the officer-involved shooting that occurred at about 12:10 a.m. on southbound U.S. Highway 101 near the Santa Barbara Road exit.

The Sheriff's Office says Gallardo had a warrant out for his arrest for a domestic violence incident that occurred in June 2016. 

"One of the Deputies involved in today's incident had taken the original domestic violence report and was familiar with the suspect and the suspect's vehicle," said Tony Cipolla with the Sheriff's Office. The following words are taken directly from a SLO County Sheriff's statement to the press:

As the Deputies were on patrol this morning, they recognized the vehicle, pulled alongside it as it was traveling southbound on Highway 101 , identified the driver as Gallardo and knew he was wanted on domestic violence charges. That's when the traffic stop was initiated. 

The suspect pulled his vehicle over to the side of the road. The two Deputies approached the vehicle and made contact with Gallardo. At that point, the suspect pulled a gun on the Deputies. The Deputies fired shots and then retreated. Backup units arrived on scene and the area was cleared. At that time, it was discovered the suspect was deceased.
